Your Agreement with 57ink Photography
Welcome to the website of 57ink Photography, a wholly owned brand of 57ink Photography, LLC, a premier professional real estate photography service. The following terms of service apply to your use of this website and any photos produced for internet usage. By engaging our services, you agree to these terms. Please review them carefully before sharing or distributing the photos produced. These terms constitute a legal agreement between you (“Client”) and 57ink Photography LLC, DBA 57ink Photography. By using 57ink Photography, you indicate your acceptance of these terms. If you do not agree, please exit the website.
Usage Rights of Photos
The Client has the exclusive right to use photos for MLS listings and subsequent marketing purposes only. Clients can use photos for listing and marketing their brand, including real estate agency, brokerage, and team.
Limitations of Use
The Client may not use images for mass advertising in magazines without consent and/or image credit as determined by 57ink Photography. Images may not be distributed or sold to third parties such as stagers, interior designers, builders, contractors, or construction companies. The Client may not file copyright for the images under their name. If a third party wishes to use or purchase the rights to the images, please contact hello@57inkphotography.com.
Copyright
All real estate or interior photography is owned by 57ink Photography. The content of this website, including graphics, design, and look and feel, is owned by 57ink Photography and protected by United States copyright laws. All photographs in this gallery are subject to copyrights of 57ink Photography and protected by US Copyright Law. Reproduction, storage, or transmission by any means, of any image on this website, whole or in part, is prohibited without express prior written permission.
Photo Archive Limits
Photos produced by 57ink Photography will be hosted for a period of ONE YEAR from the time of production.
Use of Photographs
You may purchase photographs featured on this website. If you purchase a photograph, you may not reproduce, display, transmit, distribute, or exploit the picture, or any portion thereof, in any manner, without prior written consent from 57ink Photography. Photographs are intended for listing use and subsequent marketing for the Real Estate Agent and Company. Photographs may not be used to suggest an affiliation with or endorsement by any entity not affiliated with you. Photos may be submitted for virtual staging through a third party.
Disclaimers
Photographs are provided “as is.” All implied warranties are hereby disclaimed, including warranties of title, infringement, merchantability, and fitness for a particular purpose. Floor plan illustrations are approximations and provided for convenience only with seller permission. All measurements are approximate and not guaranteed to be exact or to scale. Confirm measurements using your own sources.
While 57ink Photography endeavors to ensure compliance with applicable laws, it makes no representations or warranties regarding the accuracy, correctness, or reliability of photographs or floor plans. 57ink Photography cannot ensure that all persons depicted in photographs have consented to their display. If your photograph appears without consent and you wish to have it removed, please contact us at hello@57inkphotography.com. 57ink Photography cannot guarantee the functionality of this website, its error-free status, or the absence of viruses. Your use of this website is at your own risk.
In no event shall the site owners, employees, subsidiaries, affiliates, and representatives be liable for any damages, including lost business or profits, loss of data, or any direct, indirect, incidental, consequential, special, or punitive damages, whether for breach of contract, negligence, or otherwise, even if advised of the possibility of such damages.
You agree that the site owners’ maximum liability arising from any photograph or product shall not exceed the purchase price. You are responsible for any unauthorized use of photographs or products.
Indemnification and Termination Policy
If you use photographs in an unauthorized manner or infringe intellectual property rights, you agree to indemnify and hold 57ink Photography harmless against any losses or damages, including reasonable attorneys’ fees. This agreement is governed by the laws of the State of Texas. 57ink Photography reserves the right to make changes to this website and agreement without notice.
These Terms of Use constitute the entire agreement between you and 57ink Photography. Failure to enforce any provision does not constitute a waiver. If a court finds a provision invalid, the remainder shall be enforceable to the fullest extent permitted by law.
Liability Release
You forever release and discharge 57ink Photography and its affiliates from any claims arising from the exercise of rights granted under this Release.
Cancellation Policy
In the event of a cancellation or reschedule:
- Less than 24 hours’ notice from session scheduled time: $100.00
- Less than 48 hours’ notice from session scheduled time: $50.00
Return to Property Charges
If 57ink Photography is required to return to the property for any reason, a $100 administrative charge plus any regular travel-related surcharge will apply.
